Labiim Terms of Service (Full Version Applicable to European and American Markets)

1. Definitions and Scope of Application

1.1 Entity Definitions

  • Labiim: Refers to the Labiim company.
  • User: A natural person or legal entity that purchases products through Labiim's official website (https://www.labiimlife.com/), and the user's location must be in the European Union or the United States.

1.2 Scope of Application

  • These terms apply to transactions conducted through Labiim's official website, covering product purchases, after - sales services, and data interaction behaviors.
  • Geographical Restriction: Services are only provided to users within the European Union (EEA) and the United States. Users in other regions need to comply with local laws.

2. Validity and Amendment of Terms

2.1 Effectiveness and Acceptance

  • When a user places an order for the first time, it is deemed that the user agrees to these terms. In case of any amendment to the terms, users will be notified 30 days in advance via email and website pop - up windows.
  • Material Amendment: If the user does not object in writing within 30 days, it is deemed that the user accepts the amendment.

2.2 Priority of Terms

  • These terms supersede all oral or written agreements. In case of a conflict with mandatory laws in the EU/US, local laws shall prevail.

3. Products and Services

3.1 Products for Sale

  • Product List: Towel Warmer, Hair Dryer, Desk Fan.
  • Compliance Statement:
    • EU Market: Complies with CE and RoHS Directives, and provides an English instruction manual.
    • US Market: Complies with FCC certification, and provides an English instruction manual.

3.2 Prohibited Acts

  • Users shall not disassemble, modify the products, or use them for non - designed purposes (such as using the towel warmer in the bathroom).

4. User Rights

4.1 Special Rights of EU Users

  • Right of Return: Users have the right to return products without reason within 30 days (no reason needs to be stated), and the user shall bear the shipping cost.
  • Right to Data Access: Users can request to export their personal data at any time (in accordance with Article 20 of the GDPR).

4.2 Special Rights of US Users

  • Right to Privacy: Users can request to delete their personal data (in accordance with CCPA §1798.120).
  • Waiver of Class Action: Users waive the right to non - monetary class actions against Labiim (such as false advertising).

5. Dispute Resolution and Applicable Law

5.1 Jurisdiction

  • For EU Users: These terms are governed by EU laws, including the GDPR and the Consumer Rights Directive.
  • For US Users: These terms are governed by US federal laws, including the Federal Arbitration Act, and the laws of the state where the user is located.

5.2 Dispute Resolution Mechanism

  • Negotiation First: Disputes shall be resolved through written negotiation, and the negotiation period is 30 natural days.
  • Arbitration Clause:
    • EU Disputes: Submit to the Arbitration Institute of the Stockholm Chamber of Commerce (SCC), in accordance with the UNCITRAL rules, and the place of arbitration is Stockholm.
    • US Disputes: Submit to the New York International Arbitration Center (NYIAC), in accordance with the AAA International Arbitration Rules, and the place of arbitration is New York.
  • Enforcement of Award: Arbitration awards can be directly enforced in EU and US member states in accordance with the New York Convention.

6. Data Protection and Privacy

6.1 Data Storage and Processing

  • For EU Users: Personal data is only stored on servers within the EU, and transmission to non - GDPR - compliant countries is prohibited.
  • For US Users: Data is stored on US servers, but data transmission to EU users needs to be carried out through Standard Contractual Clauses (SCC).

6.2 Third - Party Services

  • The social media sharing function requires a jump to the native platform (such as Facebook, Instagram), and Labiim does not store authorization information.

7. Limitation of Liability and Exemption

7.1 Cap on Liability for Compensation

  • The compensation for direct losses shall not exceed 200% of the order amount; Labiim is exempt from liability for indirect losses (such as loss of profits).

7.2 Force Majeure

  • Labiim shall not be liable for performance obstacles caused by war, natural disasters, or government actions.

8. Other Provisions

8.1 Service of Legal Documents

  • For EU Users: Serve by registered mail or encrypted email.
  • For US Users: Serve by email or through the United States Postal Service (USPS).
